Andrew John Pascale

Andrew (“Andy”) J. Pascale is an accomplished lawyer whose practice focuses on consumer finance and commercial litigation. Andy prides himself on successfully counseling clients in all aspects of civil litigation, from pre-suit planning through appellate representation. Andy has worked in many types of consumer and creditor finance areas of civil litigation including FDCPA, TCPA, and FCCPA claims and regularly counsels consumer lenders on regulatory compliance. He has also worked on the probating of estates, real estate partitions, commercial evictions and commercial breach of contract and tort claims. In addition, Andy has successfully tried dozens of residential foreclosure cases throughout Florida, and has acted as appellate counsel to lenders. For instance, in 2014 Andy served as lead appellate counsel in a case of of first impression. The decision affirms that subsequent mortgage assignees of the original first mortgage of a foreclosed property are entitled to the safe harbor limitation of the lesser of twelve months of association assessments or one percent of the original mortgage debt.
